Why Did I Get Pulled Over?
In Arizona, law enforcement must have a legitimate reason to pull you over while you’re driving, but any legitimate reason will do. You can be pulled over for any improper driving activity such as driving too fast or too slow, not using your signal lights, not staying in your lane, not wearing a seat belt, rolling through a stop sign, or having a broken light or windshield on your car. Law enforcement can also run your license plate and determine if your registration and driver’s license are valid. If they’re not, you will be pulled over.
The reason why a police officer pulls you over may not be the exact reason why you get a ticket. For example, a police officer may pull you over because of a broken brake light. However, upon speaking with you, the officer may smell alcohol on your breath or hear you slurring your words and arrest you for DUI. That ticket is still valid even though the officer did not see you driving erratically and you can still be convicted of DUI.
Police officers may use any excuse to pull you over if they have a hunch that you might be driving under the influence. It only takes one lane change without signaling or peeling out of a parking lot too fast to give them a valid reason to pull you over. And remember, you can be charged with a DUI in Arizona if your driving is impaired by any level of alcohol or drugs. You could have a blood-alcohol content of 0.01% and get a DUI if the court determines that you were impaired. Arizona Revised Statutes § 28-1381 governs DUIs for people impaired by drugs or a blood-alcohol content under 0.015%.
If you are going to drink and drive with a blood-alcohol level that is less than 0.08, be sure you can drive impeccably. Follow every driving law to the letter. Do not do anything that will give law enforcement an excuse to pull you over.
