Extreme DUI Information & Penalties

Extreme DUI Charges

First Offense with a BAC between 0.15 – 0.199

If you have been charged with a violation of A.R.S. § 28-1382.A.1, then you were found driving a vehicle under the extreme influence of alcohol. Extreme DUI’s can result in thirty times the amount of jail time than a regular DUI.

  • 30 or more days in jail
    *Depending on the court and if the court will allow a substitute interlock ignition device, you may do as little as 3 days in jail with the remainder of your time in home detention
  • Fines, surcharges, jail fees, DPS assessments, prison fund fees reaching $4,000 or more
  • Suspension of your driver’s license for at least 90 days
  • Use of an interlock ignition device for up to 12 months
  • Substance abuse screening followed by the recommended counseling
  • Attendance at a Mothers Against Drunk Driving (“MADD”) Victim Impact Panel
  • Probation up to 5 years
  • Attendance at traffic school because you have received 8 points on your driver’s record
  • Possible impoundment of vehicle
  • Possible court order to perform community restitution
  • An SR-22 insurance policy, which is a special high-risk insurance policy that costs approximately $500 or more per year for three years from date of violation—adding an additional $1,500.

Second DUI Offense with a BAC between 0.15 – 0.199

If you have been charged with a violation of A.R.S. § 28-1382.A.1 within 7 years of your first offense, the penalties will be more severe. It is considered a second offense Extreme DUI if you had any kind of DUI offense within the last 7 years, and the current DUI is extreme.

Second offense extreme DUI penalties include:

  • At least 120 days in jail
  • Fines, surcharges, jail fees, DPS assessments, prison fund fees reaching $4,000 or more.
  • Revocation of your driver’s license for at least one year (you may be eligible for a SIIRDL)
  • Use of an interlock ignition device for at least 12 months
  • Substance abuse screening followed by recommended counseling
  • Attendance at a Mothers Against Drunk Driving (“MADD”) Victim Impact Panel
  • Probation for up to 5 years
  • Attendance at traffic survival school because you have attained 8 points on your driver’s record
  • 30 hours of community restitution
  • An SR-22 insurance policy, which is a special high-risk insurance policy that costs $500 per year for three years from date of violation — adding an additional $1,500.
