64-year-old Jessie Thornton who lives in Surprise, Arizona said cops told him that they could tell he was drunk simply by looking at him. Thornton explained a late-night swim might have led to the DUI accusation due to his swim giving him bloodshot and watery eyes, which are common signs of potential impairment. Thornton was charged with a DUI despite the fact that a breathalyzer test showed he had a blood-alcohol content of 0.000.

With a BAC of 0.000, the situation should have been resolved quickly, but Thornton was evaluated for possible drug use as well. The police proceeded to do a field sobriety test even though Thornton stated that he had bad knees, a bad hip and was scheduled to have hip surgery in two days.

Thornton now claims that it wasn’t DUI but motivated by race. Surprise police have pulled him over 10 times and this latest incident prompted him to hire a lawyer with plans to sue the department for $500,000.
