Arizona Drug DUI Charges

The DUI laws in Arizona state that you can be charged with DUI if your driving is impaired by any amount of alcohol or drugs. Arizona DUI charges that are due to alcohol consumption are based on the blood-alcohol content of your blood. All of these charges are misdemeanors.

The DUI laws based on drugs do not have similar divisions based on level of intoxication. If you are arrested for DUI based on drug consumption, you will be charged with DUI. You cannot be charged with extreme DUI or super extreme DUI if you are impaired by drugs.  If you are convicted of DUI due to drugs, you will face the following mandatory penalties:

  • 10 days in jail (9 days may be suspended),
  • Driver’s license revoked for 1 year
  • $1,250 in fines and fees,
  • Ignition interlock device, and
  • Possible community restitution.

When you are convicted of DUI because you were impaired by drugs, you will lose your driver’s license for 1 year. This is much long than the 90-day driver’s license suspension you’ll face if you are convicted of your first DUI due to alcohol. You should also be aware that you can be charged and convicted of DUI due to drugs because of your use of street drugs or prescription drugs. You can get a DUI even if you were taking prescription medication that was legitimately prescribed by a doctor.

You can be charged with aggravated DUI based on drugs in Arizona. You can get an aggravated DUI if you get a DUI due to drugs if you get a DUI while your license is suspended due to a prior DUI, get a DUI with a person under age 15 in the vehicle, or if you get three DUIs within an 84-month period regardless of what substance you were using. Aggravated DUI is a felony in Arizona.
