Arizona DUI Court Process

The Arizona DUI court process is complex and will vary depending upon your specific situation – such as whether your DUI is considered a misdemeanor or a felony offense, and other factors. Motor Vehicle Division (MVD)

Separate from your criminal court case for your DUI charge, you will need to have a Motor Vehicle Division (MVD) hearing. Your MVD hearing directly addresses your right to drive in Arizona, and so is a top priority. There are also specific deadlines in regards to your MVD hearing that you must observe to avoid automatic license suspension.

DUI Criminal Court Process

  • Your Arizona DUI criminal court process begins with your appearance before a judge. Your DUI attorney may be able to attend this appearance for you, depending upon whether your DUI charge is classified as a felony or misdemeanor. At this first appearance, your charges will be read and bail may be set depending upon the gravity of your DUI charge.
  • The next step is a preliminary hearing, unless there has been an indictment (a formal accusation of a serious DUI charge). At this preliminary hearing, the judge will decide whether or not there is enough evidence to support the DUI charges against you. Additional charges may be added and you may even be ordered back into custody.
  • In cases of aggravated DUI, an arraignment at the Superior Court will follow. At that time, you will be informed of your charges and will be able to answer to them.
  • A pre-trial conference is the next step in the Arizona DUI criminal court process. At this conference, your DUI attorney may be able to negotiate a plea with the prosecution.
  • Finally, the DUI criminal trial begins. If you are found guilty, this trial will lead to your sentencing, which could mean jail time, prison, probation, or fines. By having an experienced DUI attorney, you may be able to receive alternative sentencing such as counseling, substance abuse classes, electronic home monitoring, or more.
